According to 7 U.S. Code 5940, the term "industrial hemp" means the plant cannabis native L. and any part of such plant, whether growing or not, with a Delta-9 tetrahydrocannabinol (delta-9 THC) concentration of no more than 0.3% on a dry weight basis. Only the Delta-9 THC level is relevant, not the THC-A.
